Additional Terms

1. Events

Recify provides consumers with opportunities to purchase from certain businesses (“Businesses”, and each a “Business”) certain events (“Events”) including, but not limited to, such things as classes, group activities, other group gatherings.

2. Products

Recify provides consumers with opportunities to purchase certain products (“Products”) owned, sold offered or otherwise provided by certain Businesses. Products further include any services which are not otherwise an Event or Scheduled Service.

3. Rentals

Recify provides consumers with opportunities to rent certain items (“Rentals”) owned, sold, offered or otherwise provided by certain Businesses.

4. Educational Materials

Recify provides consumers with opportunities to purchase or otherwise obtain certain digitally delivered materials (“Educational Materials”) owned, sold, offered, or otherwise provided by certain Businesses.

5. Scheduled Services

Recify provides consumers with opportunities to schedule, purchase or otherwise obtain certain services (“Scheduled Services”) owned, sold, offered, or otherwise offered by certain Businesses, including, but not limited to, such things as private training, private practitioner services (such as massage therapy sessions), and other private or individual activities.

6.  Reci-Deals

Recify provides consumers with opportunities to purchase Events, Products, Rentals, Educational Materials, and Scheduled Services (“Reci-Deals”) owned, sold, offered, or otherwise provided by Businesses The promotion of each Reci-Deal works as a form of advertisement for the Business by Recify. Often times, a Reci-Deal provides discounted pricing or other incentives or features not usually available.

7. Responsibility

Agreement between You and Businesses.  Events, Products, Rentals, Educational Materials, Scheduled Services and Reci-Deals are owned, offered, provided, operated or otherwise arranged for by third party Businesses.  The specific listing and purchase details (“Fine Print”) will accompany any Events, Products, Rentals, Educational Materials, Scheduled Services and Reci-Deals  By purchasing, accepting, using or attending any Events, Products, Rentals, Educational Materials, Scheduled Services and Reci-Deals, you agree to these Terms and the Fine Print identified with each.  Such agreement by you represents a legal agreement between you and the Business and your understanding that the purchasing, accepting, using or attending any Events, Products, Rentals, Educational Materials, Scheduled Services and Reci-Deals is by You from the Business and not Recify.  It is understood that the Recify website is a software platform that is made available by Recify that Businesses may utilize to provide goods and services to consumers, such as you. For this service, Recify collects certain non-refundable service fees directly from the merchant accounts of the Businesses.

Recify is not responsible for the safety, efficacy, listing, content, programing, availability, delivery, provision or other disposition of any Events, Products, Rentals, Educational Materials, Scheduled Services, Reci-Deals, Newsletters, Forms, CRM, and Enterprise Education Features offered by any Business. Recify makes no representations or warranties regarding any Events, Products, Rentals, Educational Materials, Scheduled Services, Reci-Deals, Newsletters, Forms, CRM, and Enterprise Education Features.  Recify is not responsible for any errors or omissions found before, during, or after any Events, Products, Rentals, Educational Materials, Scheduled Services, Reci-Deals, Newsletters, Forms, CRM, and Enterprise Education Features. You agree to indemnify, defend and hold harmless Recify and its subsidiaries, affiliates, partners, officers, directors, employees and agents from, any liabilities arising from or related to with your purchase or use of any Events, Products, Rentals, Educational Materials, Scheduled Services, Reci-Deals, Newsletters, Forms, CRM, and Enterprise Education Features.

8. Newsletters

Businesses may use Recify to send newsletters (“Newsletters”) to their customers via email. Each Business is responsible for maintaining their own email list.  Subscribing and unsubscribing is the responsibility of each Business.  Spamming type of violations are strictly the responsibility of the Business. Each Business using Recify to send emails agrees to the Recify Privacy Policy.

9.  Forms

Recify provides opportunities for Businesses to create online forms (“Forms”) including, but not limited to, for using in collecting such items as personal information, medical data, waivers and other liability releases. Businesses may collect data from customers. That data will be stored in a way that meets the international “Safe Harbor” requirements.

10. Customer Resource Management (CRM)

Recify provides opportunities for Businesses to create and collect Customer Resource Management records (“CRM”) including through the collection of data such items as personal information, email address, mailing address, phone numbers, images of the user, any data or files provided by the user, etc. Businesses may collect data from customers. That data will be stored in a way that meets the international “Safe Harbor” requirements.

11. Enterprise Education

Recify provides opportunities for Businesses to provide Educational Materials, products and services and to use for the management and certification of students and instructors (“Enterprise Education Features”), including through the collection of data such items as personal information, email address, mailing address, phone numbers, images of the user, any data or files provided by the user, etc. Businesses may collect data from customers. That data will be stored in a way that meets the international “Safe Harbor” requirements.

12. Customer Satisfaction, Warranty, and Refund Policy

Customer satisfaction, warranties, and refunds are specifically the responsibility of the Business. Recify explicitly does not warrant the accuracy of any Events, Products, Rentals, Educational Materials, Schedules Services and Reci-Deals.

The Business is specifically responsible for the accuracy, efficacy, and safety of any Events, Products, Rentals, Educational Materials, Scheduled Services and Reci-Deals listed on the Recify website or published via a Recify module.

Customer service, warranties, and refunds, as they pertain to any Events, Products, Rentals, Educational Materials, Scheduled Services listed on the Recify website or published via a Recify module are specifically the responsibility of the Business.

Any request for customer service, warranties, or refunds made directly to Recify will be forwarded to the Business.

Recify requires that Businesses respond to any customer service, warranties, or refund requests within three business days.

In no case will Recify be responsible for any refund or return of any monies to any customer.

Recify service fees are non-refundable. Credit card fees are the responsibility of the Business.

If a customer is not able to reach a satisfactory resolution with the Business, the complaint may be escalated to the Recify Customer Service department at [email protected] /* */, which will attempt to act as an intermediary between the customer and the Business. In no case will Recify ever provide a refund or credit to an end user/customer.
